努力健全以職代會為基本形式的企業民主管理制度
——在中央企業職代會建設座談會上的講話

  剛才,國家(jia)電網、寶鋼集團和中國中鐵介紹了職代(dai)會(hui)建設的(de)典型經(jing)驗,還有30家(jia)企(qi)業做(zuo)了書面交流。這些在職代(dai)會(hui)建設實踐中形成的(de)經(jing)驗和做(zuo)法,各企(qi)業可學(xue)習借鑒。借此機會(hui),我(wo)談三點意見。

  一、中央企業職代會建設取(qu)得了(le)良好成(cheng)效(xiao)

  國(guo)(guo)資委(wei)(wei)(wei)黨委(wei)(wei)(wei)高度重視以職(zhi)(zhi)(zhi)代(dai)(dai)會(hui)(hui)為(wei)基本形(xing)式的(de)(de)企(qi)(qi)(qi)業(ye)(ye)(ye)民主(zhu)管理工(gong)(gong)作(zuo)(zuo)。先后作(zuo)(zuo)出(chu)一系(xi)列部署,采取(qu)一系(xi)列有針對性的(de)(de)措施切實加以推進。印(yin)發了(le)《關于建(jian)(jian)(jian)立(li)和完(wan)善(shan)中(zhong)(zhong)央(yang)(yang)企(qi)(qi)(qi)業(ye)(ye)(ye)職(zhi)(zhi)(zhi)工(gong)(gong)代(dai)(dai)表大會(hui)(hui)制(zhi)度的(de)(de)指導意見(jian)》,舉(ju)辦了(le)中(zhong)(zhong)央(yang)(yang)企(qi)(qi)(qi)業(ye)(ye)(ye)貫(guan)徹(che)職(zhi)(zhi)(zhi)代(dai)(dai)會(hui)(hui)指導意見(jian)研(yan)討(tao)培訓班(ban),集中(zhong)(zhong)開展了(le)職(zhi)(zhi)(zhi)代(dai)(dai)會(hui)(hui)建(jian)(jian)(jian)設(she)(she)(she)和廠務公開民主(zhu)管理督導檢查工(gong)(gong)作(zuo)(zuo),開展了(le)職(zhi)(zhi)(zhi)代(dai)(dai)會(hui)(hui)制(zhi)度建(jian)(jian)(jian)設(she)(she)(she)專題(ti)調研(yan),召開了(le)中(zhong)(zhong)央(yang)(yang)企(qi)(qi)(qi)業(ye)(ye)(ye)深化廠務公開民主(zhu)管理工(gong)(gong)作(zuo)(zuo)和職(zhi)(zhi)(zhi)代(dai)(dai)會(hui)(hui)建(jian)(jian)(jian)設(she)(she)(she)座談會(hui)(hui),與中(zhong)(zhong)紀委(wei)(wei)(wei)、中(zhong)(zhong)組部等六部委(wei)(wei)(wei)聯合印(yin)發了(le)《企(qi)(qi)(qi)業(ye)(ye)(ye)民主(zhu)管理規定》,國(guo)(guo)資委(wei)(wei)(wei)群工(gong)(gong)局(ju)最近(jin)正(zheng)在組織編寫《職(zhi)(zhi)(zhi)工(gong)(gong)代(dai)(dai)表大會(hui)(hui)工(gong)(gong)作(zuo)(zuo)指南》。近(jin)年來(lai),中(zhong)(zhong)央(yang)(yang)企(qi)(qi)(qi)業(ye)(ye)(ye)認真貫(guan)徹(che)中(zhong)(zhong)央(yang)(yang)和全國(guo)(guo)總(zong)工(gong)(gong)會(hui)(hui)、國(guo)(guo)資委(wei)(wei)(wei)黨委(wei)(wei)(wei)的(de)(de)工(gong)(gong)作(zuo)(zuo)要(yao)求,緊(jin)密結合完(wan)善(shan)現代(dai)(dai)企(qi)(qi)(qi)業(ye)(ye)(ye)制(zhi)度、提升企(qi)(qi)(qi)業(ye)(ye)(ye)管理水平等現實需求,不斷深化職(zhi)(zhi)(zhi)代(dai)(dai)會(hui)(hui)建(jian)(jian)(jian)設(she)(she)(she)。目前,有79家中(zhong)(zhong)央(yang)(yang)企(qi)(qi)(qi)業(ye)(ye)(ye)建(jian)(jian)(jian)立(li)了(le)集團公司職(zhi)(zhi)(zhi)代(dai)(dai)會(hui)(hui),建(jian)(jian)(jian)制(zhi)率為(wei)69.9%,特別要(yao)充分(fen)肯定的(de)(de)是二級企(qi)(qi)(qi)業(ye)(ye)(ye)職(zhi)(zhi)(zhi)代(dai)(dai)會(hui)(hui)建(jian)(jian)(jian)制(zhi)率超過98%,在建(jian)(jian)(jian)立(li)現代(dai)(dai)企(qi)(qi)(qi)業(ye)(ye)(ye)制(zhi)度建(jian)(jian)(jian)設(she)(she)(she)規范董事會(hui)(hui)58戶(hu)中(zhong)(zhong)央(yang)(yang)企(qi)(qi)(qi)業(ye)(ye)(ye)中(zhong)(zhong)有32戶(hu)設(she)(she)(she)立(li)了(le)職(zhi)(zhi)(zhi)工(gong)(gong)董事。

  (一)黨(dang)政(zheng)領導(dao)高度重(zhong)視(shi),工(gong)作(zuo)制度不(bu)斷完善,工(gong)作(zuo)機制日(ri)益健全,為全面加強職(zhi)代(dai)(dai)(dai)會(hui)(hui)建設(she)夯實了基(ji)礎。一是(shi)明確(que)了企業黨(dang)委(wei)(wei)(黨(dang)組)和(he)經營班子在推進職(zhi)代(dai)(dai)(dai)會(hui)(hui)建設(she)中(zhong)的職(zhi)責,以及(ji)堅持企業黨(dang)委(wei)(wei)(黨(dang)組)領導(dao)職(zhi)代(dai)(dai)(dai)會(hui)(hui)的重(zhong)要原則(ze)。二(er)是(shi)結(jie)合實際(ji),制定了職(zhi)代(dai)(dai)(dai)會(hui)(hui)工(gong)作(zuo)制度和(he)實施細則(ze),對職(zhi)代(dai)(dai)(dai)會(hui)(hui)職(zhi)權、組織原則(ze)、工(gong)作(zuo)制度、職(zhi)工(gong)代(dai)(dai)(dai)表管理等作(zuo)出明確(que)規定。三是(shi)按照多級(ji)職(zhi)代(dai)(dai)(dai)會(hui)(hui)建設(she)的要求,逐級(ji)向下,指導(dao)所屬基(ji)層企業結(jie)合實際(ji),細化落實,全面提升(sheng)了職(zhi)代(dai)(dai)(dai)會(hui)(hui)工(gong)作(zuo)的科學化和(he)規范化水平(ping)。

  (二)努力探(tan)索落實(shi)職(zhi)(zhi)代會(hui)的(de)(de)(de)各項(xiang)(xiang)職(zhi)(zhi)權(quan)(quan),職(zhi)(zhi)代會(hui)在(zai)民(min)主(zhu)管理和(he)(he)依法維權(quan)(quan)中(zhong)的(de)(de)(de)作用(yong)得到有(you)效發揮。一是在(zai)堅持(chi)董(dong)事(shi)會(hui)依法對(dui)企(qi)業(ye)經(jing)營(ying)計(ji)劃、投(tou)資方案(an)(an)等(deng)(deng)重(zhong)(zhong)(zhong)(zhong)要(yao)(yao)事(shi)項(xiang)(xiang)行(xing)(xing)使決策權(quan)(quan)、經(jing)理層(ceng)(ceng)依法行(xing)(xing)使經(jing)營(ying)權(quan)(quan)和(he)(he)管理權(quan)(quan)的(de)(de)(de)前(qian)提(ti)下,職(zhi)(zhi)代會(hui)對(dui)企(qi)業(ye)重(zhong)(zhong)(zhong)(zhong)要(yao)(yao)事(shi)項(xiang)(xiang)、經(jing)營(ying)方面的(de)(de)(de)重(zhong)(zhong)(zhong)(zhong)大問題、制(zhi)訂重(zhong)(zhong)(zhong)(zhong)要(yao)(yao)規章制(zhi)度等(deng)(deng)行(xing)(xing)使審議建議權(quan)(quan)。二是對(dui)于董(dong)事(shi)會(hui)、經(jing)理層(ceng)(ceng)制(zhi)訂的(de)(de)(de)涉(she)及職(zhi)(zhi)工切(qie)身利益(yi)的(de)(de)(de)有(you)關方案(an)(an),包括企(qi)業(ye)改制(zhi)中(zhong)的(de)(de)(de)職(zhi)(zhi)工安置(zhi)方案(an)(an)、職(zhi)(zhi)工獎懲辦(ban)法重(zhong)(zhong)(zhong)(zhong)要(yao)(yao)規章制(zhi)度、集體合同(tong)草(cao)案(an)(an)、企(qi)業(ye)年金方案(an)(an)、住房制(zhi)度改革方案(an)(an)等(deng)(deng)涉(she)及職(zhi)(zhi)工切(qie)身利益(yi)的(de)(de)(de)重(zhong)(zhong)(zhong)(zhong)大事(shi)項(xiang)(xiang)堅持(chi)提(ti)交(jiao)職(zhi)(zhi)代會(hui)審議和(he)(he)表(biao)決,行(xing)(xing)使審議通(tong)過(guo)權(quan)(quan)。三是在(zai)遵(zun)循黨管干(gan)部原則和(he)(he)尊重(zhong)(zhong)(zhong)(zhong)董(dong)事(shi)會(hui)、經(jing)理層(ceng)(ceng)行(xing)(xing)使企(qi)業(ye)人(ren)員聘用(yong)權(quan)(quan)的(de)(de)(de)前(qian)提(ti)下,明確了職(zhi)(zhi)代會(hui)對(dui)企(qi)業(ye)經(jing)營(ying)班子成員的(de)(de)(de)監督評議權(quan)(quan),每年或定期組織職(zhi)(zhi)工代表(biao)聽(ting)取(qu)企(qi)業(ye)領導(dao)班子成員報(bao)告(gao)履行(xing)(xing)職(zhi)(zhi)責和(he)(he)廉潔自(zi)律的(de)(de)(de)情況。

  (三)加(jia)強職(zhi)(zhi)工(gong)(gong)(gong)(gong)代(dai)表(biao)(biao)(biao)(biao)(biao)隊伍建設,充分發(fa)揮職(zhi)(zhi)工(gong)(gong)(gong)(gong)代(dai)表(biao)(biao)(biao)(biao)(biao)在(zai)引導廣大職(zhi)(zhi)工(gong)(gong)(gong)(gong)參(can)與改(gai)(gai)革(ge)、推進改(gai)(gai)革(ge)中的(de)(de)作(zuo)(zuo)用(yong)。各企(qi)業高(gao)度(du)重視職(zhi)(zhi)工(gong)(gong)(gong)(gong)代(dai)表(biao)(biao)(biao)(biao)(biao)的(de)(de)素質(zhi)提升工(gong)(gong)(gong)(gong)作(zuo)(zuo),組織(zhi)職(zhi)(zhi)工(gong)(gong)(gong)(gong)代(dai)表(biao)(biao)(biao)(biao)(biao)學習(xi)黨的(de)(de)路(lu)線方(fang)針政(zheng)策、國家法(fa)(fa)律(lv)法(fa)(fa)規、企(qi)業管理(li)知識;向職(zhi)(zhi)工(gong)(gong)(gong)(gong)代(dai)表(biao)(biao)(biao)(biao)(biao)講清楚企(qi)業改(gai)(gai)革(ge)的(de)(de)方(fang)向、內容、要(yao)求,改(gai)(gai)革(ge)的(de)(de)前景、風險和(he)(he)挑戰,回答職(zhi)(zhi)工(gong)(gong)(gong)(gong)代(dai)表(biao)(biao)(biao)(biao)(biao)關注(zhu)的(de)(de)熱點(dian)、難點(dian)問題(ti);結合(he)黨的(de)(de)群(qun)眾路(lu)線教育(yu)實踐活動,組織(zhi)職(zhi)(zhi)工(gong)(gong)(gong)(gong)代(dai)表(biao)(biao)(biao)(biao)(biao)深入基層(ceng)調(diao)查研究(jiu),增強了(le)職(zhi)(zhi)工(gong)(gong)(gong)(gong)代(dai)表(biao)(biao)(biao)(biao)(biao)的(de)(de)榮譽(yu)感(gan)、責任心(xin);積極推廣職(zhi)(zhi)工(gong)(gong)(gong)(gong)代(dai)表(biao)(biao)(biao)(biao)(biao)履職(zhi)(zhi)的(de)(de)典(dian)型經驗(yan),堅持(chi)在(zai)廣大職(zhi)(zhi)工(gong)(gong)(gong)(gong)代(dai)表(biao)(biao)(biao)(biao)(biao)中選(xuan)先進、樹標桿。這些做法(fa)(fa),既有效提高(gao)了(le)職(zhi)(zhi)工(gong)(gong)(gong)(gong)代(dai)表(biao)(biao)(biao)(biao)(biao)參(can)與企(qi)業管理(li)和(he)(he)監督評議的(de)(de)能(neng)力,又對于教育(yu)和(he)(he)引導包括職(zhi)(zhi)工(gong)(gong)(gong)(gong)代(dai)表(biao)(biao)(biao)(biao)(biao)在(zai)內的(de)(de)廣大職(zhi)(zhi)工(gong)(gong)(gong)(gong)正確看待改(gai)(gai)革(ge)、擁(yong)護(hu)支持(chi)改(gai)(gai)革(ge)、參(can)與推動改(gai)(gai)革(ge),發(fa)揮了(le)重要(yao)作(zuo)(zuo)用(yong)。

  (四)堅(jian)持開展職(zhi)代(dai)(dai)(dai)(dai)會效能評(ping)估,為(wei)加(jia)強職(zhi)代(dai)(dai)(dai)(dai)會的實(shi)效性和提高職(zhi)工(gong)(gong)滿意度(du)提供了(le)保障(zhang)。部(bu)分企業(ye)(ye)堅(jian)持在黨委(黨組(zu))領(ling)導(dao)下,每年組(zu)織(zhi)開展對(dui)本(ben)企業(ye)(ye)上一(yi)(yi)年度(du)職(zhi)代(dai)(dai)(dai)(dai)會運行質量的評(ping)估工(gong)(gong)作(zuo)(zuo)(zuo)。評(ping)估采取召開職(zhi)工(gong)(gong)代(dai)(dai)(dai)(dai)表座(zuo)談會、開展職(zhi)工(gong)(gong)代(dai)(dai)(dai)(dai)表個別訪談、組(zu)織(zhi)職(zhi)工(gong)(gong)代(dai)(dai)(dai)(dai)表民(min)主(zhu)(zhu)(zhu)測評(ping)等多種方(fang)式進(jin)(jin)(jin)行。對(dui)評(ping)估的情(qing)況(kuang)進(jin)(jin)(jin)行綜合分析,特(te)別是針(zhen)對(dui)薄弱環節,深入分析職(zhi)工(gong)(gong)群眾不滿意的原(yuan)因,提出(chu)改(gai)進(jin)(jin)(jin)意見,積極落實(shi)整(zheng)改(gai),并(bing)向職(zhi)代(dai)(dai)(dai)(dai)會報(bao)告工(gong)(gong)作(zuo)(zuo)(zuo)改(gai)進(jin)(jin)(jin)情(qing)況(kuang)。多數中央(yang)(yang)企業(ye)(ye)能夠逐級(ji)開展職(zhi)代(dai)(dai)(dai)(dai)會建設先(xian)進(jin)(jin)(jin)單位(wei)的創建活動,發揮典型單位(wei)的示范引領(ling)作(zuo)(zuo)(zuo)用。2013年,近(jin)百家中央(yang)(yang)企業(ye)(ye)(含二、三級(ji)企業(ye)(ye))榮獲(huo)全(quan)國(guo)廠(chang)務公開民(min)主(zhu)(zhu)(zhu)管(guan)理先(xian)進(jin)(jin)(jin)單位(wei)稱號(hao)。為(wei)此(ci),全(quan)國(guo)廠(chang)務公開協調小組(zu)辦公室認為(wei)“中央(yang)(yang)企業(ye)(ye)在推進(jin)(jin)(jin)廠(chang)務公開民(min)主(zhu)(zhu)(zhu)管(guan)理制(zhi)度(du)工(gong)(gong)作(zuo)(zuo)(zuo)中一(yi)(yi)直走在前列(lie),為(wei)全(quan)國(guo)的廠(chang)務公開民(min)主(zhu)(zhu)(zhu)管(guan)理工(gong)(gong)作(zuo)(zuo)(zuo)做出(chu)了(le)好的榜(bang)樣(yang)”。

  在充分肯定工(gong)作成績的(de)(de)(de)(de)同時(shi),我們也要(yao)看(kan)到,中(zhong)央(yang)企(qi)業(ye)(ye)(ye)職(zhi)代(dai)(dai)會(hui)建(jian)設還很(hen)不(bu)平(ping)衡(heng)。一是(shi)確實(shi)存在少數企(qi)業(ye)(ye)(ye)領(ling)導特別是(shi)個別企(qi)業(ye)(ye)(ye)的(de)(de)(de)(de)主要(yao)領(ling)導對職(zhi)代(dai)(dai)會(hui)建(jian)設的(de)(de)(de)(de)重(zhong)要(yao)性和(he)必要(yao)性認識不(bu)夠,思想(xiang)顧慮多(duo),工(gong)作措施和(he)有(you)效辦法(fa)少。二是(shi)有(you)的(de)(de)(de)(de)企(qi)業(ye)(ye)(ye)職(zhi)代(dai)(dai)會(hui)職(zhi)權內容(rong)、運(yun)作程(cheng)序及工(gong)作制度(du)陳舊,不(bu)能與現(xian)代(dai)(dai)企(qi)業(ye)(ye)(ye)制度(du)有(you)效銜接(jie)。三是(shi)有(you)的(de)(de)(de)(de)企(qi)業(ye)(ye)(ye)職(zhi)代(dai)(dai)會(hui)存在走過場(chang)、搞(gao)形式主義,發揮作用(yong)不(bu)夠的(de)(de)(de)(de)問題(ti)。這些問題(ti)影響了(le)職(zhi)代(dai)(dai)會(hui)建(jian)設,也在一定程(cheng)度(du)上影響了(le)企(qi)業(ye)(ye)(ye)管理水平(ping)的(de)(de)(de)(de)提升。

  二、進一步增強抓(zhua)好職代會建設的積(ji)極性和責任感

  建(jian)立和(he)完(wan)善職工(gong)代表大(da)會制(zhi)度(du),是(shi)堅持(chi)全(quan)心(xin)全(quan)意依靠工(gong)人階級的(de)(de)(de)指導方(fang)針和(he)堅持(chi)職工(gong)主體(ti)地位(wei)的(de)(de)(de)體(ti)現,是(shi)國(guo)有企業的(de)(de)(de)政(zheng)治優勢,是(shi)中國(guo)特色現代企業制(zhi)度(du)的(de)(de)(de)本(ben)質要求,也是(shi)國(guo)有企業改革(ge)發展取得(de)成功的(de)(de)(de)重(zhong)要保障(zhang)。

  建(jian)立和(he)完善職工(gong)(gong)代表大(da)會(hui)(hui)(hui)(hui)(hui)制(zhi)(zhi)度(du),是深入學(xue)習(xi)貫(guan)徹黨(dang)(dang)的(de)(de)(de)(de)十(shi)八(ba)屆三中全(quan)會(hui)(hui)(hui)(hui)(hui)和(he)習(xi)近(jin)平總(zong)(zong)書(shu)(shu)記(ji)(ji)系(xi)列(lie)重要(yao)講話(hua)精神(shen)的(de)(de)(de)(de)客觀要(yao)求。黨(dang)(dang)的(de)(de)(de)(de)十(shi)八(ba)屆三中全(quan)會(hui)(hui)(hui)(hui)(hui)指出:“健(jian)全(quan)以職工(gong)(gong)代表大(da)會(hui)(hui)(hui)(hui)(hui)為基(ji)本形式的(de)(de)(de)(de)企(qi)事業單位(wei)民(min)(min)(min)主(zhu)(zhu)(zhu)(zhu)管(guan)理制(zhi)(zhi)度(du),加強社會(hui)(hui)(hui)(hui)(hui)組織(zhi)民(min)(min)(min)主(zhu)(zhu)(zhu)(zhu)機(ji)制(zhi)(zhi)建(jian)設,保障職工(gong)(gong)參與(yu)管(guan)理和(he)監督的(de)(de)(de)(de)民(min)(min)(min)主(zhu)(zhu)(zhu)(zhu)權(quan)(quan)利(li)”。習(xi)近(jin)平總(zong)(zong)書(shu)(shu)記(ji)(ji)在(zai)同全(quan)國總(zong)(zong)工(gong)(gong)會(hui)(hui)(hui)(hui)(hui)新一屆領導(dao)班子(zi)集(ji)體談話(hua)時明確(que)指出:“要(yao)健(jian)全(quan)以職工(gong)(gong)代表大(da)會(hui)(hui)(hui)(hui)(hui)為基(ji)本形式的(de)(de)(de)(de)企(qi)事業單位(wei)民(min)(min)(min)主(zhu)(zhu)(zhu)(zhu)管(guan)理制(zhi)(zhi)度(du)、廠務公開制(zhi)(zhi)度(du),組織(zhi)職工(gong)(gong)依法實行民(min)(min)(min)主(zhu)(zhu)(zhu)(zhu)選舉、民(min)(min)(min)主(zhu)(zhu)(zhu)(zhu)決策、民(min)(min)(min)主(zhu)(zhu)(zhu)(zhu)管(guan)理、民(min)(min)(min)主(zhu)(zhu)(zhu)(zhu)監督,使職工(gong)(gong)群眾的(de)(de)(de)(de)知情權(quan)(quan)、參與(yu)權(quan)(quan)、表達權(quan)(quan)、監督權(quan)(quan)得到更充分更有效的(de)(de)(de)(de)保障”。我們要(yao)從深入貫(guan)徹黨(dang)(dang)的(de)(de)(de)(de)十(shi)八(ba)屆三中全(quan)會(hui)(hui)(hui)(hui)(hui)、習(xi)近(jin)平總(zong)(zong)書(shu)(shu)記(ji)(ji)系(xi)列(lie)重要(yao)講話(hua)精神(shen)的(de)(de)(de)(de)高度(du),增強做好中央企(qi)業職代會(hui)(hui)(hui)(hui)(hui)建(jian)設工(gong)(gong)作的(de)(de)(de)(de)自覺性。

  建立和(he)完善職(zhi)工代(dai)表大(da)會(hui)(hui)制度,是《憲(xian)(xian)法(fa)(fa)(fa)》及(ji)相關法(fa)(fa)(fa)律(lv)的(de)明確規(gui)(gui)定。《憲(xian)(xian)法(fa)(fa)(fa)》第(di)十六條第(di)二(er)款規(gui)(gui)定:國有(you)企業(ye)(ye)依(yi)(yi)照法(fa)(fa)(fa)律(lv)規(gui)(gui)定,通(tong)過(guo)(guo)職(zhi)工代(dai)表大(da)會(hui)(hui)和(he)其他形式(shi),實(shi)行民主(zhu)管(guan)理。《工會(hui)(hui)法(fa)(fa)(fa)》第(di)六條第(di)二(er)款規(gui)(gui)定:工會(hui)(hui)依(yi)(yi)照法(fa)(fa)(fa)律(lv)規(gui)(gui)定通(tong)過(guo)(guo)職(zhi)工代(dai)表大(da)會(hui)(hui)或者其他形式(shi),組織(zhi)職(zhi)工參與本單位(wei)的(de)民主(zhu)決策、民主(zhu)管(guan)理和(he)民主(zhu)監督。事實(shi)上,凡(fan)未經職(zhi)代(dai)會(hui)(hui)審議(yi)通(tong)過(guo)(guo)的(de)企業(ye)(ye)年(nian)金方(fang)案,職(zhi)工安置方(fang)案等(deng),無法(fa)(fa)(fa)通(tong)過(guo)(guo)政府相關部(bu)門的(de)審核。特別是在全面深化改(gai)革(ge)過(guo)(guo)程中(zhong)(zhong),企業(ye)(ye)內(nei)部(bu)許多改(gai)革(ge)措(cuo)施必須經過(guo)(guo)職(zhi)代(dai)會(hui)(hui)等(deng)規(gui)(gui)范的(de)民主(zhu)程序,才具備法(fa)(fa)(fa)律(lv)效力。以前,一些企業(ye)(ye)在改(gai)革(ge)改(gai)制、兼并重(zhong)組以及(ji)涉(she)及(ji)職(zhi)工切(qie)實(shi)利益的(de)決策過(guo)(guo)程中(zhong)(zhong),沒(mei)有(you)依(yi)(yi)法(fa)(fa)(fa)履行民主(zhu)程序,采取所(suo)謂“變通(tong)”方(fang)式(shi),留下了許多法(fa)(fa)(fa)律(lv)隱患。中(zhong)(zhong)央企業(ye)(ye)各級領導干部(bu)要切(qie)實(shi)增(zeng)強依(yi)(yi)法(fa)(fa)(fa)做好企業(ye)(ye)民主(zhu)管(guan)理工作的(de)緊迫感和(he)責任感。

  建(jian)立(li)和(he)(he)(he)完(wan)善職(zhi)工(gong)(gong)代(dai)表(biao)大會(hui)(hui)制(zhi)度(du)(du)(du),是(shi)(shi)建(jian)立(li)現代(dai)企業制(zhi)度(du)(du)(du)、完(wan)善公(gong)司(si)(si)治(zhi)(zhi)(zhi)理(li)結(jie)構(gou)的(de)(de)迫切需要。建(jian)立(li)現代(dai)企業制(zhi)度(du)(du)(du)的(de)(de)核(he)心是(shi)(shi)使(shi)所有者、經營(ying)者、勞動者之間通(tong)過股東會(hui)(hui)、董(dong)(dong)事(shi)會(hui)(hui)、監事(shi)會(hui)(hui)、經理(li)層以及(ji)黨組織、職(zhi)代(dai)會(hui)(hui)形成各負其責(ze)、協調運(yun)轉、有效(xiao)制(zhi)衡(heng)的(de)(de)關系,使(shi)公(gong)司(si)(si)法人(ren)治(zhi)(zhi)(zhi)理(li)結(jie)構(gou)更趨完(wan)善和(he)(he)(he)合理(li)。其中(zhong)(zhong)(zhong),黨組織發揮政治(zhi)(zhi)(zhi)核(he)心作用(yong)和(he)(he)(he)職(zhi)工(gong)(gong)民主管(guan)理(li)是(shi)(shi)國有企業公(gong)司(si)(si)治(zhi)(zhi)(zhi)理(li)結(jie)構(gou)中(zhong)(zhong)(zhong)最具(ju)中(zhong)(zhong)(zhong)國特色(se)的(de)(de)內容。在規范(fan)董(dong)(dong)事(shi)會(hui)(hui)建(jian)設的(de)(de)企業中(zhong)(zhong)(zhong),職(zhi)工(gong)(gong)董(dong)(dong)事(shi)的(de)(de)產生(sheng)、履職(zhi)盡(jin)責(ze)和(he)(he)(he)報(bao)告工(gong)(gong)作都需要通(tong)過職(zhi)代(dai)會(hui)(hui)這(zhe)個平臺(tai)來作支(zhi)撐。實踐表(biao)明,職(zhi)代(dai)會(hui)(hui)具(ju)有廣(guang)泛的(de)(de)代(dai)表(biao)性、充分(fen)的(de)(de)民主性、法定的(de)(de)權威性和(he)(he)(he)組織制(zhi)度(du)(du)(du)的(de)(de)嚴密性,能(neng)夠有效(xiao)增(zeng)強(qiang)廣(guang)大職(zhi)工(gong)(gong)群(qun)眾的(de)(de)主人(ren)翁意識,充分(fen)調動職(zhi)工(gong)(gong)群(qun)眾的(de)(de)積極性、主動性和(he)(he)(he)創造性,最大限度(du)(du)(du)地(di)集中(zhong)(zhong)(zhong)廣(guang)大職(zhi)工(gong)(gong)的(de)(de)智慧(hui)和(he)(he)(he)力量,持續(xu)不斷地(di)提升企業管(guan)理(li)水平、切實有效(xiao)地(di)防范(fan)企業經營(ying)風險。

  建立和完(wan)善職(zhi)(zhi)(zhi)工代表大會制度,是切(qie)實維(wei)護職(zhi)(zhi)(zhi)工合法(fa)權(quan)(quan)(quan)益、推進中央企業(ye)反(fan)腐倡廉建設的必然要求。健(jian)全以(yi)職(zhi)(zhi)(zhi)工代表大會為基本形(xing)式的企業(ye)民主管理(li)制度,組織職(zhi)(zhi)(zhi)工依法(fa)進行(xing)民主管理(li),保(bao)(bao)障職(zhi)(zhi)(zhi)工的知情權(quan)(quan)(quan)、參(can)與(yu)(yu)權(quan)(quan)(quan)、表達權(quan)(quan)(quan)、監(jian)(jian)(jian)(jian)督權(quan)(quan)(quan),使企業(ye)負(fu)責人自覺接受黨內監(jian)(jian)(jian)(jian)督、群眾監(jian)(jian)(jian)(jian)督,能增強廉潔從業(ye)的自覺性,確(que)保(bao)(bao)權(quan)(quan)(quan)力在群眾的有效監(jian)(jian)(jian)(jian)督下(xia)運行(xing),對于打造“陽光(guang)央企”、構建企業(ye)職(zhi)(zhi)(zhi)工廣泛(fan)參(can)與(yu)(yu)的懲治與(yu)(yu)預防(fang)腐敗體(ti)系等都具有積極促進意義。

  三、切實抓好職代會(hui)建設,推動(dong)中央(yang)企業深化(hua)改革、科(ke)學發(fa)展

  當前(qian),中央(yang)企業面(mian)臨全(quan)面(mian)深化(hua)改革(ge)的重(zhong)要(yao)任務,改革(ge)涉及方(fang)(fang)方(fang)(fang)面(mian)面(mian),內容多(duo)、范圍廣、挑戰大,更加需要(yao)我(wo)們發揮(hui)職(zhi)代會制度在深化(hua)改革(ge)、科學發展中的重(zhong)要(yao)作用。

  (一)黨(dang)委(wei)(黨(dang)組)要(yao)(yao)進(jin)一步發(fa)揮領導作用(yong)。建(jian)(jian)(jian)立和完善職(zhi)代(dai)會(hui)(hui)(hui)制度(du),是(shi)(shi)中央(yang)企(qi)(qi)業(ye)黨(dang)委(wei)(黨(dang)組)的(de)(de)(de)(de)(de)一項重要(yao)(yao)職(zhi)責。總(zong)的(de)(de)(de)(de)(de)目標:一是(shi)(shi)二級(ji)、三(san)級(ji)公司職(zhi)代(dai)會(hui)(hui)(hui)全覆蓋;二是(shi)(shi)條件成熟的(de)(de)(de)(de)(de)集團公司也應(ying)積極建(jian)(jian)(jian)立職(zhi)代(dai)會(hui)(hui)(hui),已建(jian)(jian)(jian)立集團工會(hui)(hui)(hui)的(de)(de)(de)(de)(de)企(qi)(qi)業(ye)實(shi)現職(zhi)代(dai)會(hui)(hui)(hui)全覆蓋;三(san)是(shi)(shi)已建(jian)(jian)(jian)職(zhi)代(dai)會(hui)(hui)(hui)的(de)(de)(de)(de)(de)企(qi)(qi)業(ye),進(jin)一步加強規范化建(jian)(jian)(jian)設,不(bu)斷提升職(zhi)代(dai)會(hui)(hui)(hui)質量(liang)和水平。中央(yang)企(qi)(qi)業(ye)黨(dang)委(wei)(黨(dang)組)要(yao)(yao)切實(shi)把握職(zhi)代(dai)會(hui)(hui)(hui)的(de)(de)(de)(de)(de)正(zheng)確(que)政治方向(xiang),積極支持(chi)職(zhi)代(dai)會(hui)(hui)(hui)發(fa)揮作用(yong),研究解決職(zhi)代(dai)會(hui)(hui)(hui)建(jian)(jian)(jian)設中的(de)(de)(de)(de)(de)有關問(wen)題,使職(zhi)代(dai)會(hui)(hui)(hui)成為(wei)黨(dang)密切聯系群眾、教育引導群眾、組織發(fa)動群眾、傾聽群眾呼(hu)聲、維護職(zhi)工權益的(de)(de)(de)(de)(de)有效渠(qu)道。

  (二(er))董事(shi)(shi)會(hui)和(he)經(jing)理(li)層要(yao)大(da)力支持職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)代會(hui)建設。積(ji)極促進(jin)企(qi)業(ye)(ye)民(min)(min)主管(guan)理(li)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)與(yu)現代企(qi)業(ye)(ye)制度的(de)(de)(de)有機結合。一(yi)(yi)是(shi)(shi)(shi)要(yao)進(jin)一(yi)(yi)步理(li)順(shun)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)代會(hui)與(yu)企(qi)業(ye)(ye)法人(ren)治理(li)結構的(de)(de)(de)關系。不斷完善各項(xiang)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)制度,開(kai)展管(guan)理(li)創(chuang)新(xin)和(he)制度創(chuang)新(xin),形成董事(shi)(shi)會(hui)、監(jian)事(shi)(shi)會(hui)、經(jing)理(li)層和(he)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)代會(hui)有效(xiao)銜接、協調運轉(zhuan)、相互制衡的(de)(de)(de)格局(ju)。二(er)是(shi)(shi)(shi)堅持“三(san)重一(yi)(yi)大(da)”決策事(shi)(shi)項(xiang)事(shi)(shi)先聽取工(gong)(gong)(gong)(gong)(gong)會(hui)和(he)廣大(da)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)群眾的(de)(de)(de)意見(jian)建議(yi)(yi),“三(san)重一(yi)(yi)大(da)”決策事(shi)(shi)項(xiang)的(de)(de)(de)執行(xing)情(qing)況(kuang)向職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)公開(kai),提(ti)交職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)代會(hui)審(shen)議(yi)(yi)。在(zai)深化企(qi)業(ye)(ye)改(gai)革中,涉及職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)切身利益的(de)(de)(de)重大(da)事(shi)(shi)項(xiang)提(ti)交職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)代會(hui)討論審(shen)議(yi)(yi)通(tong)(tong)過,凡涉及到職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)轉(zhuan)崗安置等(deng)問題,職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)安置方案須(xu)提(ti)交職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)代會(hui)審(shen)議(yi)(yi)通(tong)(tong)過,這是(shi)(shi)(shi)落實職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)代會(hui)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)權的(de)(de)(de)基(ji)本要(yao)求,也是(shi)(shi)(shi)企(qi)業(ye)(ye)民(min)(min)主管(guan)理(li)的(de)(de)(de)底線。三(san)是(shi)(shi)(shi)自覺接受職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)群眾的(de)(de)(de)監(jian)督評議(yi)(yi)。企(qi)業(ye)(ye)領導班子(zi)和(he)領導人(ren)員(yuan)要(yao)向職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)代表(biao)大(da)會(hui)報告履行(xing)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)責(ze)和(he)廉(lian)潔自律的(de)(de)(de)情(qing)況(kuang),接受職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)代表(biao)的(de)(de)(de)民(min)(min)主評議(yi)(yi),這既是(shi)(shi)(shi)中央的(de)(de)(de)要(yao)求,也是(shi)(shi)(shi)加強企(qi)業(ye)(ye)反腐倡廉(lian)建設的(de)(de)(de)要(yao)求,也是(shi)(shi)(shi)凝聚人(ren)心的(de)(de)(de)要(yao)求。

  (三)工(gong)(gong)(gong)(gong)(gong)會(hui)(hui)要在職(zhi)(zhi)(zhi)(zhi)(zhi)代(dai)會(hui)(hui)工(gong)(gong)(gong)(gong)(gong)作中(zhong)發揮應有(you)作用(yong)。工(gong)(gong)(gong)(gong)(gong)會(hui)(hui)作為(wei)職(zhi)(zhi)(zhi)(zhi)(zhi)代(dai)會(hui)(hui)的工(gong)(gong)(gong)(gong)(gong)作機(ji)構,要運用(yong)各種形(xing)式向職(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)群眾宣傳(chuan)民(min)主(zhu)管(guan)理的有(you)關知(zhi)識,組(zu)織(zhi)傳(chuan)達(da)職(zhi)(zhi)(zhi)(zhi)(zhi)代(dai)會(hui)(hui)精(jing)神,宣傳(chuan)和發動職(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)落實職(zhi)(zhi)(zhi)(zhi)(zhi)代(dai)會(hui)(hui)決(jue)(jue)議;要抓好職(zhi)(zhi)(zhi)(zhi)(zhi)代(dai)會(hui)(hui)籌備和組(zu)織(zhi)工(gong)(gong)(gong)(gong)(gong)作;要為(wei)職(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)群眾反映意見(jian)、要求(qiu)和建議創造(zao)條件;要加(jia)強職(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)代(dai)表培訓(xun)工(gong)(gong)(gong)(gong)(gong)作,開展職(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)代(dai)表巡視(shi)活動;深(shen)入開展職(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)提案工(gong)(gong)(gong)(gong)(gong)作,組(zu)織(zhi)職(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)代(dai)表對職(zhi)(zhi)(zhi)(zhi)(zhi)代(dai)會(hui)(hui)決(jue)(jue)議和提案落實情(qing)況進行檢查。工(gong)(gong)(gong)(gong)(gong)會(hui)(hui)要結合企業實際,創造(zao)性的開展工(gong)(gong)(gong)(gong)(gong)作,發揮工(gong)(gong)(gong)(gong)(gong)會(hui)(hui)到位(wei)、盡責的作用(yong)。

  同志們,在全面深化國資國企改革中,堅持、改革、完善中央企業職代會制度面臨著一些新課題、新要求,我們要在全面深化改革中大力加強和改進中央企業職代會制度,堅定不移地貫徹落實黨的全心全意依靠工人階級的根本指導方針,匯聚同心同德、共謀發展的正能量,為推動國資國企改革發展再上新臺階,為做強做優中央企業、全面建成小康社會、實現中華民族偉大復興的中國夢作出新的更大貢獻!
